Here’s a list of the legal status of Kratom in each state as of Sept 2023.

Kratom Legal Status in the United States

States Where Kratom is Completely Legal:

      • Alaska
      • Arizona
      • Connecticut
      • Delaware
      • Georgia
      • Idaho
      • Kansas
      • Louisiana
      • Maryland
      • Massachusetts
      • Minnesota
      • Montana
      • Nebraska
      • Nevada
      • New Mexico
      • North Dakota
      • Oregon
      • Pennsylvania
      • South Carolina
      • Washington
      • West Virginia
      • Wyoming
      • Washington D.C.

States with Legal Restrictions or Partial Bans:

      • California: Illegal in San Diego (city only).
      • Colorado: Illegal in Denver for human consumption, Parker Town, and Monument Town.
      • Florida: Illegal in Sarasota County.
      • Hawaii: Pending bill to ban.
      • Illinois: Illegal in Jerseyville.
      • Kentucky: Legal but unregulated.
      • Maine: Legal but unregulated.
      • Michigan: Pending bill to include kratom among Schedule II drugs.
      • Mississippi: Illegal in several counties and cities.
      • Missouri: Few counties are debating a potential kratom ban.
      • New Hampshire: Illegal in Franklin.
      • New Jersey: Efforts to ban ongoing.
      • New York: Multiple intents to ban.
      • North Carolina: Legal for those older than 18.
      • Ohio: Considering regulating kratom.
      • Oklahoma: Pending bill to regulate kratom.
      • South Dakota: Legal for those over 21.
      • Tennessee: Plain leaf form is legal for those over 21, with a pending bill regarding sale restrictions.
      • Texas: Pending bill to regulate kratom.
      • Utah: Vendors need to comply with regulations.
